1. Acceptance of Terms

By creating an account, signing up for a 14-day free trial, or accessing any part of the Service, you confirm that you are at least 18 years old, possess the legal authority to bind your business or organization, and agree to comply with these Terms. These Terms apply to all users, including gym owners, fitness studio managers, personal trainers, front-desk staff, and administrators.

2. Account Registration & Security

To use CloudFYT, you must register an account by providing accurate, current, and complete information, including your legal business name, contact phone number, and email address.

• You are solely responsible for maintaining the confidentiality of your login credentials.
• You agree not to share your administrative login credentials with unauthorized individuals.
• You must notify CloudFYT immediately at [email protected] if you suspect any unauthorized access or security breach.

3. Subscription Plans, Billing & Taxes

CloudFYT offers tiered subscription plans (Starter, Professional, and Enterprise) billed on either a monthly or annual cycle, as displayed on our Pricing Page.

• Payment Processing: Subscription fees are charged in advance using supported payment methods (UPI, Credit/Debit Cards, Net Banking via PCI-DSS compliant gateways like Razorpay and Stripe).
• Taxes: Fees are exclusive of applicable statutory taxes (such as GST in India or 5% FTA VAT in UAE), which will be itemized on your compliant tax invoice.
• Automatic Renewals: Subscriptions automatically renew at the end of each billing period unless cancelled prior to the renewal date.
• Refunds: All fees are non-refundable except as explicitly covered under our 30-Day Money-Back Guarantee.

4. 14-Day Free Trial

We provide a 14-day free trial of CloudFYT with full feature access and zero credit card requirement. At the conclusion of the trial period, you must select an active paid plan to maintain access. If you choose not to subscribe, your account will gracefully pause without any surprise charges or automated deductions.

5. Acceptable Use Policy

You agree to use CloudFYT strictly for legitimate gym and fitness studio business operations. You must not:

• Use the Service to transmit spam, unsolicited WhatsApp/SMS messages, or harassing content.
• Attempt to decompile, reverse-engineer, copy, or extract the source code of the platform.
• Introduce malware, viruses, trojans, or attempt unauthorized penetration testing.
• Resell, sublicense, or rent the platform to third parties unless explicitly authorized under an Enterprise White-Label agreement.

6. Customer Data Ownership & Privacy

You own your data: All member records, phone numbers, payment histories, attendance logs, and financial records uploaded to CloudFYT remain 100% your exclusive intellectual property. CloudFYT acts solely as a data processor.

We never sell, monetize, or share your member databases with third-party marketers. You can export your complete database in standardized CSV/Excel format at any time directly from your dashboard.

7. Cancellation & Data Retention

You may cancel your subscription at any time with 1-click through your billing settings. Upon cancellation:

• You retain full active access to CloudFYT until the end of your prepaid billing cycle.
• You will have a 30-day grace period to download and export all your member and accounting records.
• Following the grace period, data may be securely purged from production clusters in accordance with our data retention policy.

8. Intellectual Property Rights

The CloudFYT brand, logo, user interface designs, custom icons, algorithms, and software documentation are protected under copyright, trademark, and intellectual property laws. You are granted a non-exclusive, revocable license to access the Service for your business operations during your active subscription.

9. Service Availability & Limitation of Liability

CloudFYT strives for 99.98% server uptime backed by Cloudflare's global edge network. However, we do not guarantee uninterrupted or error-free operation during scheduled maintenance or unforeseen network carrier disruptions.

To the maximum extent permitted by law, CloudFYT's cumulative liability for any claim arising out of your use of the Service shall not exceed the total amount paid by you to CloudFYT during the preceding twelve (12) months.

10. Modifications to Terms

We may periodically revise these Terms to reflect product improvements, legal amendments, or regulatory updates. We will notify you of material modifications via email or in-app announcement at least 14 days before they take effect.
